Terms of Service

1. Acceptance of terms

By creating a SwiftCS account, signing in with Google, or otherwise accessing or using the SwiftCS platform (the “Service”), you agree to be bound by these Terms of Service (the “Terms”) and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Description of the Service

SwiftCS provides an AI-powered customer service platform for WooCommerce merchants. The Service ingests inbound customer email from your connected Gmail account, synchronizes order and shipping data from connected stores and carriers (including WooCommerce, ShipStation, and UPS), drafts AI-generated replies using Anthropic's Claude API, and enables your staff to review and send those replies. SwiftCS may add, modify, or remove features over time.

3. Accounts and credentials

You are responsible for maintaining the confidentiality of your Google Account, the third-party API credentials you provide to SwiftCS, and the activity that occurs under your account. You agree to notify us immediately at admin@swiftcs.ai of any unauthorized use of your account. You must be at least 18 years old and authorized to act on behalf of the business whose accounts you connect to SwiftCS.

4. Acceptable use

You agree not to:

  • Use the Service to send spam, harass recipients, or violate any anti-spam or consumer-protection laws (including CAN-SPAM, CASL, or GDPR);
  • Use the Service to send unlawful, defamatory, fraudulent, or otherwise harmful content;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent applicable law expressly permits;
  • Probe, scan, or test the vulnerability of the Service, or breach any security or authentication measures;
  • Use the Service to develop a competing product, or to train any machine-learning model on data accessed through the Service;
  • Use the Service in a manner that violates Google's API Services User Data Policy, the Anthropic Usage Policy, or the terms of any other third-party service integrated with SwiftCS.

5. Your content

You retain all rights to the content you provide to SwiftCS, including the email messages ingested from your Gmail account, customer records, product knowledge-base entries, and AI prompts. You grant SwiftCS a limited, non-exclusive license to process, store, and transmit your content solely as necessary to provide the Service.

6. AI-generated content

The Service uses large language models (provided by Anthropic) to draft replies. AI-generated drafts may be inaccurate, incomplete, or inappropriate for a given situation. You are responsible for reviewing AI-drafted replies before they are sent to your customers. SwiftCS makes no guarantee about the accuracy, suitability, or legal compliance of AI-generated output.

7. Third-party services

The Service relies on third-party platforms including Google (Gmail), Anthropic (Claude API), Railway (hosting), WooCommerce, ShipStation, and UPS. SwiftCS is not responsible for the availability, accuracy, or terms of those third-party services. Your use of those services is subject to their respective terms and privacy policies.

8. Termination and suspension

You may stop using the Service at any time by revoking SwiftCS's Google Account permissions or by emailing admin@swiftcs.ai to request account deletion. SwiftCS may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if your account is implicated in abuse or security incidents, or if continued provision of the Service becomes commercially or legally infeasible. On termination, the rights granted to you under these Terms end immediately, and SwiftCS will delete your data in accordance with our Privacy Policy.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. SwiftCS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-DRAFTED CONTENT WILL BE ACCURATE OR APPROPRIATE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SwiftCS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE. SwiftCS'S AGGREGATE LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO SwiftCS IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).

11. Indemnification

You agree to indemnify and hold harmless SwiftCS and its affiliates from any claim, liability, damages, or expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms or applicable law, (b) the content you provide to or send through the Service, or (c) your violation of any third-party rights, including the rights of your customers under applicable privacy and consumer-protection laws.

12. Governing law

These Terms are governed by the laws of the State of [TBD — TODO: Ghassan to specify governing jurisdiction (e.g., State of Delaware, U.S.A.) before publishing], without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction and venue there.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and, for material changes, notify connected users by email. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
